Terms of Service
These Terms of Service (“Terms”) govern your use of touchstone.business and related public pages, forms, and booking tools (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who we are
Touchstone provides HR outsourcing and related support oriented to multi-unit restaurant operators. Contact: hello@touchstone.business.
2. Eligibility
The Site is intended for business use by adults (18+) acting for themselves or a company. You represent that you have authority to use the Site and submit information on behalf of the entity you name.
3. Website use
You may use the Site for lawful, legitimate business purposes—learning about our offerings and requesting a consultation. You agree not to:
- Misuse forms, spam us, or submit false or misleading information
- Attempt to probe, scrape at abusive scale, disrupt, or gain unauthorized access to the Site or systems
- Use the Site to violate law, privacy rights, or others’ intellectual property
- Reverse engineer or copy Site materials for competing commercial reuse without permission
We may suspend or block access that we reasonably believe violates these Terms or threatens security.
4. Consultations and booking
The Site may allow you to request or book a free introductory consultation (phone or video). Booking:
- Is subject to available time slots and our acceptance
- Does not create a paid client relationship by itself
- May be rescheduled or canceled by either party with reasonable notice when possible
- Stores the details you submit (including contact info and preferences) so we can confirm and hold the meeting on our calendar
You are responsible for providing accurate contact information and joining at the scheduled time. Failure to attend may result in loss of that slot without obligation on our part to offer another free session.
5. Services and pricing
Packages, pricing, features, and descriptions on the Site are summaries for marketing purposes and may change without notice. Actual scope, fees, deliverables, and responsibilities are defined only in a signed services agreement (or other written contract) between you and Touchstone. We may decline, pause, or end engagements that conflict with law, ethics, capacity, or our business judgment.
6. No legal advice; no warranties about outcomes
Touchstone provides HR management and compliance support as described in client agreements. Site content is not legal advice and is not a substitute for licensed counsel. Employment laws vary by jurisdiction. Testimonials, examples, and case-style statements are illustrative and not guarantees of results for your business.
7. User submissions
If you email us, book a meeting, or submit materials (including to careers@touchstone.business), you represent that you have the right to share that information, that it is accurate to the best of your knowledge, and that it does not violate others’ rights. You grant us a limited license to use submissions to evaluate and respond to your inquiry, application, or potential engagement. Do not upload confidential third-party employee files through public forms unless we expressly request them under a client agreement.
8. Intellectual property
Site content, branding, logos, layout, and materials are owned by Touchstone or its licensors. You may not copy, modify, distribute, or commercially exploit them without prior written permission, except for reasonable personal/business evaluation of our services or as allowed by law (e.g., fair use).
9. Third-party services and links
The Site may rely on third-party infrastructure (for example hosting, email, calendar). Those services have their own terms and privacy practices. Links to third-party sites are provided for convenience; we are not responsible for their content or practices.
10. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOUCHSTONE AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US SPECIFICALLY FOR SITE ACCESS IN THE 12 MONTHS BEFORE THE CLAIM (IF ANY), OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
This section applies to Site use. Liability for paid client services is governed by the applicable services agreement.
12. Indemnity
You agree to defend and indemnify Touchstone against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your infringement of others’ rights—except to the extent caused by our willful misconduct.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference.
14. Governing law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, unless a mandatory local law requires otherwise. Courts located in Texas shall have exclusive jurisdiction over disputes arising from Site use, except where prohibited. (If your principal business location requires a different mandatory forum, that law may apply to the extent required.)
15. Changes
We may update these Terms by posting a revised version on the Site and updating the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms for subsequent use.
